The agreement
These terms are between you and Formwire ("we"). By creating an account you agree to them, to the privacy policy and to the acceptable use policy. If you sign up on behalf of a company, you confirm you may bind it. If you process personal data from the EEA, UK or Switzerland, the data processing agreement is also part of this agreement.
What Formwire does
Formwire receives submissions from HTML forms you point at our endpoint, stores them for the retention period you set, filters spam, emails them to the recipients you choose, sends the confirmation email you set up and delivers them to your webhooks. You reach the same data through the dashboard, the API and the MCP server.
Your account
- You must be 16 or older and give a working email address.
- You are responsible for what happens under your account and keys. Keep API keys secret; form access keys are meant to be public.
- Tell us at support@formwire.com if you think an account or key has been compromised. You can revoke an API key or rotate an access key yourself at any time.
- An organization's owners and admins can add and remove members. Members see only the workspaces they are added to.
Your data and your visitors' data
Submissions belong to you. We process them only to provide the service, as described in the privacy policy and the DPA. You are responsible for telling your visitors what you collect and why, for having a lawful basis to collect it, and for not collecting things a general-purpose form service should not hold (passwords, payment card numbers, health records, government identifiers). You can export submissions to CSV or over the API, and delete them, at any time.
Acceptable use
The acceptable use policy lists what is not allowed: phishing, spam, harassment, malware, illegal content and abuse of the service or other people. We may suspend a form or a workspace immediately if we reasonably believe it is being used that way, and we will tell you why unless the law prevents it. Every submission notification and confirmation email carries a link for people to report abuse.
Plans, quotas and billing
- The Free plan is free for as long as you stay within its limits. Paid plans are billed monthly or yearly in advance. Plans, limits and prices are on the pricing page.
- Payments are handled by Paddle, which sells paid plans to you as our reseller. It charges any sales tax or VAT, issues your invoices, and its buyer terms also apply to the payment.
- Your plan's monthly submission quota is soft: going over it does not stop delivery, and we ask you to upgrade. To stop runaway traffic, a form refuses submissions once its organization is far past the quota.
- You can change or cancel your plan at any time. An upgrade starts at once; a cancellation takes effect at the end of the period you have paid for, and the account then moves to the Free plan.
- Refunds: if you ask within 7 days of your first payment for a plan, we refund it in full. After that, and for renewals, we do not refund, unless the law requires it.
- If a payment fails we retry and email you. If it is still unpaid after 14 days, the account moves to the Free plan and its limits.
- We can change prices, with at least 30 days' notice by email before a change affects a plan you are on.
Availability and support
We aim to keep the service available at all times, but we do not offer an uptime guarantee. Support is by email at support@formwire.com. We may change or retire features; for anything that affects how your forms work, we email account owners first, and we will not remove a feature your paid plan includes without an alternative or a refund of the rest of the period.
Deletion and termination
- You can delete your account from the dashboard at any time. Your sign-in details are removed at once, and organizations you own alone are deleted for good after 30 days. If other people still belong to your organization, make one of them an owner first.
- Deleted submissions and forms sit in the trash for 30 days, during which you can restore them. After that they are gone.
- We may suspend or close an account that breaks these terms or the acceptable use policy, has not paid, or that we are legally required to close. Where it is safe to do so we give you notice and a chance to export your data first.
Intellectual property
You keep every right to your forms, your websites and your submissions. We keep every right to Formwire itself. You may use our name to say that your form runs on Formwire.
No warranty
Formwire is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties of any kind, express or implied, including that the service will be uninterrupted, secure or error-free, that it is fit for a particular purpose, or that any submission, email or webhook will be received, stored or delivered. You use it at your own risk, and you are responsible for keeping your own copy of anything you cannot afford to lose.
Limits on our liability
To the fullest extent the law allows:
- We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business, goodwill or data, even if we were told they were possible.
- We are not liable for lost, delayed or undelivered submissions, emails or webhooks; for downtime; for spam that gets through or legitimate submissions that are blocked or marked as spam; or for data lost or deleted under the retention and trash periods.
- We are not liable for the acts or failures of services we rely on or that you connect, including Cloudflare, Amazon Web Services, Resend, hCaptcha, Google, GitHub, Paddle, email providers and any integration or webhook endpoint.
- Our total liability for all claims arising from or relating to Formwire or these terms is limited to the lesser of the fees you paid us in the 12 months before the claim and 100 US dollars.
Some places do not allow some of these exclusions or limits, so they apply to you only as far as the law where you live permits. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as for fraud, or for death or personal injury caused by negligence, and nothing affects rights you have as a consumer that cannot be waived.
Indemnity
You will defend and indemnify Formwire against any claim, loss, damage, fine or cost (including reasonable legal fees) arising from your forms, the content and data you collect or send through them, your use of the service, or your breach of these terms or the law.
Changes to these terms
We may update these terms. For anything material we email account owners at least 30 days before the change takes effect. If you do not agree, export your data and close your account before then; continuing to use the service after that date means you accept the change.
